Division of a Father's Wealth among the Sons of Different Wives

Yudhishthira asks how a father's property is to be divided among the sons of wives of different classes. Bhishma sets out the shares for a Brahmin's estate, divided into ten parts, then for a Kshatriya's (eight parts), a Vaishya's (five parts) and a Shudra's (equal shares). He adds rules on a daughter's and a wife's property, the seniority of the Brahmin wife, and the larger portion of the eldest son.

sarvaśāstravidhānajña rājadharmaviduttama | atīva saṃśayacchettā bhavānvai prathitaḥ kṣitau

O knower of all the scriptures and their rules, best of those who know the duties of kings, you are renowned on earth as the one who cuts away doubts completely.

Verse 2 (13.82.2)

I have a doubt, grandfather; please resolve it for me. In this painful hour of need, whom else could we ask? Now that this doubt has arisen, O king, we could ask no one else.

Note on the text: Removed the stray wiki marks (backtick and closing quote mark) round line 2 and the doubled daṇḍa the page prints after it. Line 1 = CE 13.47.2a; line 2 = CE 13.47.2c (asyām āpadi kaṣṭāyām anyaṃ pṛcchāma kaṃ vayam); line 3 is not in the critical edition (vulgate only). The alignment found no match because of the added line.

Verse 3 (13.82.3)

yathā nareṇa kartavyaṃ dharmamārgānuvartinā | etatsarvaṃ mahābāho bhavānvyākhyātumarhati

Explain to me everything that a man who follows the path of dharma ought to do, O mighty-armed one.

Note on the text: Not matched by the alignment. Line 1 is a variant of CE 13.47.3a (the CE reads yaś ca dharmaḥ sanātanaḥ where Wikisource has धर्ममार्गानुवर्तिना); line 2 = CE 13.47.3c.

Verse 4 (13.82.4)

catasro vihitā bhāryā brāhmaṇasya pitāmaha | brāhmaṇī kṣatriyā vaiśyā śūdrā ca ratimicchataḥ

Four wives are prescribed for a Brahmin, grandfather: a Brahmin woman, a Kshatriya woman, a Vaishya woman and a Shudra woman, for one who seeks pleasure.

Verse 5 (13.82.5)

tatra jāteṣu putreṣu sarvāsāṃ kurusattama | ānupūrvyeṇa kasteṣāṃ pitryaṃ dāyādyamarhati

Among the sons born of all of them, O best of the Kurus, in what order does each become entitled to the father's inheritance?

Verse 6 (13.82.6)

kena vā kiṃ tato hāryaṃ pitṛvittātpitāmaha | etadicchāmi kathitaṃ vibhāgasteṣu kaḥ smṛtaḥ

And who is to take what from the father's wealth, grandfather? I wish to hear this told: what division among them is prescribed?

brāhmaṇaḥ kṣatriyo vaiśyastrayo varṇā dvijātayaḥ | eteṣu vihito dharmo brāhmaṇasya yudhiṣṭhira

The Brahmin, the Kshatriya and the Vaishya are the three twice-born classes. Among these, Yudhishthira, the rule I shall give is the one laid down for the Brahmin.

Verse 8 (13.82.8)

vaiṣamyādathavā lobhātkāmādvā'pi parantapa | brāhmaṇasya bhavecchūdrā na tu dṛṣṭā na tu smṛtā

Whether from perversity, greed or desire, O scorcher of foes, a Brahmin may come to have a Shudra wife; but she is neither seen in the revealed texts nor recorded in the traditional law.

Verse 9 (13.82.9)

śūdrāṃ śayanamāropya brāhmaṇo yātyadhogatim | prāyaścittīyate cāpi vidhidṛṣṭena karmaṇā

A Brahmin who takes a Shudra woman to his bed sinks to a lower state, and he must make atonement by the rite the law prescribes.

Note on the text: Corrected ब्राह्मणि → ब्राह्मणो (misprint in Wikisource; the subject must be nominative, as CE 13.47.9a has brāhmaṇaḥ). Both lines are a recension variant of CE 13.47.9a, c (CE: brāhmaṇaḥ pīḍito bhavet / … vidhidṛṣṭena hetunā); the alignment found no match.

Verse 10 (13.82.10)

tatra jāteṣvapatyeṣu dviguṇaṃ syādyudhiṣṭhira | ataste niyamaṃ vitte sampravakṣyāmi bhārata

In the case of children born of such a union, the atonement is doubled, Yudhishthira. Therefore, Bharata, I shall now set out for you the rule concerning the wealth.

Note on the text: Corrected स्वाद् → स्याद् (misprint in Wikisource; CE 13.47.10a reads syād).

Verse 11 (13.82.11)

lakṣaṇyaṃ govṛṣo yānaṃ yatpradhānatamaṃ bhavet | brāhmaṇyāstaddharetputra ekāṃśaṃ vai piturdhanāt

The auspicious bull, the carriage, and whatever else is the foremost of the property: the son of the Brahmin wife is to take that, as one special share, out of the father's wealth.

Verse 12 (13.82.12)

śeṣaṃ tu daśadhā kāryaṃ brāhmaṇasvaṃ yudhiṣṭhira | tatra tenaiva hartavyāścatvāroṃśāḥ piturdhanāt

The rest of the Brahmin's wealth, Yudhishthira, is to be divided into ten parts; and of these the same son takes four parts from the father's wealth.

Note on the text: Corrected एषं → शेषं (misprint in Wikisource; एषं is not a word here, CE 13.47.12a reads śeṣaṃ).

kṣatriyāyāstu yaḥ putro brāhmaṇaḥ sopyasaṃśayaḥ | sa tu māturviśeṣeṇa trīnaṃśānhartumarhati

The son of the Kshatriya wife is also, beyond doubt, a Brahmin; but because of his mother's standing he is entitled to take three shares.

Note on the text: Corrected त्रियायास्तु → क्षत्रियायास्तु (misprint in Wikisource; dropped syllable क्ष, the sense is "of the Kshatriya wife", CE 13.47.13a reads kṣatriyāyās tu).

Verse 14 (13.82.14)

varṇe tṛtīye jātastu vaiśyāyāṃ brāhmaṇādapi | dviraṃśastena hartavyo brāhmaṇasvādyudhiṣṭhira

śūdrāyāṃ brāhmaṇājjāto nityādeyadhanaḥ smṛtaḥ | alpaṃ cāpi pradātavyaṃ śūdrāputrāya bhārata

The son born to a Brahmin of a Shudra woman is held to have no claim to wealth by right; yet something, however little, is to be given to the Shudra woman's son, Bharata.

Verse 16 (13.82.16)

daśadhā pravibhaktasya dhanasyaiva bhavetkramaḥ | savarṇāsu tu jātānāṃ samānbhāgānprakalpayet

This is the order for wealth divided into ten parts; but among sons born of wives of the same class, equal shares are to be assigned.

Verse 17 (13.82.17)

abrāhmaṇaṃ tu manyante śūdrāputramanaipuṇāt | triṣu varṇeṣu jāto hi brāhmaṇādbrāhmaṇo bhavet

Because of his lack of competence, men regard the Shudra woman's son as not a Brahmin; but one born to a Brahmin in the three classes is a Brahmin.

Verse 18 (13.82.18)

smṛtāśca varṇāścatvāraḥ pañcamo nādhigamyate | harecca daśamaṃ bhāgaṃ śūdrāputraḥ piturdhanāt

Four classes are recorded, and a fifth is not to be found. The Shudra woman's son takes a tenth part of the father's wealth.

tattu dattaṃ haretpitrā nādattaṃ hartumarhati | avaśyaṃ hi dhanaṃ deyaṃ śūdrāputrāya bhārata

But that he may take only when the father has given it; he is not entitled to take what has not been given. Yet wealth must certainly be given to the Shudra woman's son, Bharata.

Verse 20 (13.82.20)

ānṛśaṃsyaṃ paro dharma iti tasmai pradīyate | yatratatra samutpannaṃ guṇāyaivopapadyate

Kindness is the highest duty, and so it is given to him; a gift made wherever and to whomever leads only to merit.

Verse 21 (13.82.21)

yadyapyeṣa suputraḥ syādaputro yadi vā bhavet | nādhikaṃ daśamāddadyācchūdrāputrāya bhārata

Even if he is a worthy son, or even if the father has no other son, he should not give the Shudra woman's son more than a tenth, Bharata.

Note on the text: Not matched by the alignment. Line 1 is a variant of CE 13.47.21a (CE: yadi vāpy ekaputraḥ syād aputro yadi vā bhavet); line 2 = CE 13.47.21c.

smṛta ekaścaturbhāgaḥ kanyābhāgastu dharmataḥ | abhrātṛkā samagrārhā cārthasyetyapare viduḥ

One fourth part is recorded as the unmarried daughter's share, by the law. A daughter who has no brother is entitled to the whole of the property, so others hold.

Note on the text: Removed the stray wiki marks (backtick, apostrophe and doubled daṇḍa) round this bracketed couplet. Corrected समग्राहा → समग्रार्हा and चार्धास्येत्यपरे → चार्थस्येत्यपरे (misprints in Wikisource; the CE star passage reads samagrārhā cārthasyety apare viduḥ). Not in the critical edition's constituted text: both lines are the CE star passage 13.47.21d*0308_01-02, printed there after 13.47.21d.

Verse 23 (13.82.23)

traivārṣikādyadā bhaktādadhikaṃ syāddvijasya tu | yajeta tena dravyeṇa na vṛthā sādhayeddhanam

When a twice-born man has more than provisions for three years, he should perform sacrifice with that wealth; he should not amass wealth to no purpose.

Note on the text: Corrected त्रैवार्विकाद् → त्रैवार्षिकाद् (misprint in Wikisource; CE 13.47.22a reads traivārṣikād).

Verse 24 (13.82.24)

trisahasraparo dāyaḥ striyai deyo dhanasya vai | bhartrā tacca dhanaṃ dattaṃ yathārhaṃ bhoktumarhati

A gift of wealth to a wife should not exceed three thousand; and whatever wealth her husband has given her, she is entitled to enjoy as is fitting.

Note on the text: Not matched by the alignment; recension variant of CE 13.47.23a, c (CE: striyo deyo dhanasya vai / tac ca bhartrā dhanaṃ dattaṃ nādattaṃ bhoktum arhati).

strīṇāṃ tu patidāyādyamupabhogaphalaṃ smṛtam | nāpahāraṃ striyaḥ kuryuḥ pitṛvittātkathañcana

For women, what comes from the husband's inheritance is held to be only for their enjoyment; women must never appropriate any of the paternal estate.

Verse 26 (13.82.26)

striyāstu yadbhavedvittaṃ pitrā dattaṃ yudhiṣṭhira | brāhmaṇyāstaddharetkanyā yathā putrastathā'sya sā

Whatever property a woman has received from her father, Yudhishthira, her daughter takes it from the Brahmin wife; for her she is as a son.

sā hi putrasamā rājanvihitā kurunandana | evameva samuddiṣṭo dharmo vai bharatarṣabha | evaṃ dharmamanusmṛtya na vṛthā sādhayeddhanam

For she is ordained to be like a son, O king, O joy of the Kurus. In this way the law has been laid down, best of the Bharatas. Remembering this law, one should not amass wealth to no purpose.

If the son born of a Shudra woman to a Brahmin is held to have no claim on the wealth, then for what special reason is even a tenth given to him?

Verse 29 (13.82.29)

brāhmaṇyāṃ brāhmaṇājjāto brāhmaṇaḥ syānna saṃśayaḥ | kṣatriyāyāṃ tathaiva syādvaiśyāyāmapi caiva hi

tisraḥ kṛtvā puro bhāryāḥ paścādvindeta brāhmaṇīm | sā jyeṣṭhā sā ca pūjyā syātsā ca tābhyo garīyasī

If a man first takes three wives and afterwards marries a Brahmin woman, she is the eldest, she is to be honoured, and she is more important than those three.

Verse 33 (13.82.33)

When wealth and wives are being carried off on every side by robbers, the king becomes the protector of all the classes.

Verse 46 (13.82.46)

bhūyānsyātkṣatriyāputro vaiśyāputrānna saṃśayaḥ | bhūyastenāpi hartavyaṃ pitṛvittādyudhiṣṭhira

The Kshatriya wife's son is certainly greater than the sons of a Vaishya wife, and he too is to take more from the father's wealth, Yudhishthira.

Verse 47 (13.82.47)

uktaṃ te vidhivadrājanbrāhmaṇasya pitāmaha | itareṣāṃ tu varṇānāṃ kathaṃ vai niyamo bhavet

You have told me the rule for the Brahmin in due form, grandfather. What would the rule be for the other classes?

Note on the text: Not matched by the alignment; recension variant of CE 13.47.46a, c (CE: brāhmaṇasve … kathaṃ viniyamo bhavet). The CE's star lines 13.47.45d*0309_01-02, after the preceding verse, are not on the page.

Verse 48 (13.82.48)

kṣatriyasyāpi bhārye dve vihite kurunandana | tṛtīyā ca bhavecchūdrā na tu dṛṣṭā na tu smṛtā

Two wives are prescribed for a Kshatriya as well, O joy of the Kurus; a third may be a Shudra woman, but she is neither seen in the revealed texts nor recorded in the traditional law.

Note on the text: Corrected स्मूता → स्मृता (misprint in Wikisource; CE 13.47.47c reads smṛtā).

Verse 49 (13.82.49)

eṣa eva kramo hi syātkṣatriyāṇāṃ yudhiṣṭhira | aṣṭadhā tu bhavetkāryaṃ kṣatriyasvaṃ janādhipa

This same order holds for Kshatriyas, Yudhishthira. A Kshatriya's property is to be divided into eight parts, O lord of men.

Verse 50 (13.82.50)

kṣatriyāyā haretputraścaturoṃśānpiturdhanāt | yuddhāvahārikaṃ yacca pituḥ syātsa harettu tat

The Kshatriya wife's son takes four shares of the father's wealth, and whatever the father had taken in war, that he takes as well.

Note on the text: Corrected स्वात् → स्यात् (misprint in Wikisource; CE 13.47.49c reads syāt). Wikisource ends this couplet with a single daṇḍa where the double one is expected; the division is kept, since the couplet is exactly CE 13.47.49a, 49c and the next verse begins a new CE verse (13.47.50).

Verse 51 (13.82.51)

vaiśyāputrastu bhāgāṃstrīñśūdrāputrastathāṣṭamam | ekaiva hi bhavedbhāryā vaiśyasya kurunandana | dvitīyā tu bhavecchūdrā na tu dṛṣṭā na tu smṛtā

The Vaishya wife's son takes three shares, and the Shudra woman's son the eighth. A Vaishya, O joy of the Kurus, should have only one wife; a second may be a Shudra woman, but she is neither seen in the revealed texts nor recorded in the traditional law.

Note on the text: Rebuilt from the raw page: Wikisource's table rows 51-55 each carry lines of the neighbouring verse (the verse-end marks on the page fall at the end of the first line of the next row, and the last line of row 56 is a stray "0"). Following the page's verse-end marks, this three-line verse is rows 51a, 51b, 52a. Lines = CE 13.47.50a (the CE's line 50c, "so 'pi dattaṃ haret pitrā …", comes later on the page, in the fifth rebuilt verse), 13.47.51a, 13.47.51c (CE: dvitīyā vā bhavec chūdrā na tu dṛṣṭāntataḥ smṛtā; Wikisource has तु for वा and न तु स्मृता).

Verse 52 (13.82.52)

vaiśyasya vartamānasya vaiśyāyāṃ bharatarṣabha | śūdrāyāṃ cāpi kaunteya tayorviniyamaḥ smṛtaḥ

For a Vaishya who has a Vaishya wife, best of the Bharatas, and also a Shudra wife, Kaunteya, the rule between the two is laid down thus.

Note on the text: Rebuilt from the raw page (see the note on the previous verse): rows 52b and 53a, which the page's verse-end mark joins into one verse. Lines = CE 13.47.52a, 13.47.52c (CE: śūdrāyāṃ caiva kaunteya).

Verse 53 (13.82.53)

pañcadhā tu bhavetkāryaṃ vaiśyasvaṃ bharatarṣabha | tayorapatye vakṣyāmi vibhāgaṃ ca janādhipa

A Vaishya's property is to be divided into five parts, best of the Bharatas; and I shall tell you, O lord of men, the division between the children of the two.

Note on the text: Rebuilt from the raw page (see the note two verses back): rows 53b and 54a. Lines = CE 13.47.53a, 13.47.53c.

Verse 54 (13.82.54)

vaiśyāputreṇa hartavyāścatvāroṃśāḥ piturdhanāt | pañcamastu smṛto bhāgaḥ śūdrāputrāya bhārata

The Vaishya wife's son takes four shares from the father's wealth, and the fifth share, Bharata, is reckoned for the Shudra woman's son.

Note on the text: Rebuilt from the raw page (see the note three verses back): rows 54b and 55a. Corrected स्मृतोः → स्मृतो (misprint in Wikisource; stray visarga). Lines = CE 13.47.54a, 13.47.54c (CE: pañcamas tu bhaved bhāgaḥ).

Verse 55 (13.82.55)

sopi dattaṃ haretpitrā nādattaṃ hartumarhati | tribhirvarṇaiḥ sadā jātaḥ śūdro deyadhano bhavet

He too may take only what the father has given; he is not entitled to take what has not been given. A Shudra son born to men of the three classes is always one to whom something is to be given.

Note on the text: Rebuilt from the raw page (see the note four verses back): rows 55b and 56a. Corrected त्रिमिर्वर्णैः → त्रिभिर्वर्णैः (misprint in Wikisource; म for भ, CE 13.47.55c reads tribhir varṇais). Lines = CE 13.47.55a, 13.47.55c. The "0" printed on the page after this verse (the second line of row 56) stands in for no text and is dropped.

Verse 56 (13.82.56)

śūdrasya syātsavarṇaiva bhāryā nānyā kathañcana | samabhāgāśca putrāḥ syuryadi putraśataṃ bhavet

A Shudra should have only a wife of his own class, never another; and if he has a hundred sons, they are to take equal shares.

Note on the text: Not matched by the alignment. Line 1 = CE 13.47.56a; line 2 is a variant of CE 13.47.56c (CE: śūdrasya samabhāgaḥ syād yadi putraśataṃ bhavet). On the page this verse is rows 57a-57b; the stray "0" printed before it is dropped (see the previous verse).

Verse 57 (13.82.57)

jātānāṃ samavarṇāyāḥ putrāṇāmaviśeṣataḥ | sarveṣāmeva varṇānāṃ samabhāgo dhanātsmṛtaḥ

Among sons born of a wife of the same class there is no distinction among them; for all the classes an equal share in the wealth is laid down.

Note on the text: Not matched by the alignment; recension variant of CE 13.47.57a, c (CE: jātānāṃ samavarṇāsu putrāṇām aviśeṣataḥ / sarveṣām eva varṇānāṃ samabhāgo dhane smṛtaḥ).

Verse 58 (13.82.58)

jyeṣṭhasya bhāgo jyeṣṭhaḥ syādekāṃśo yaḥ pradhānataḥ | eṣa dāyavidhiḥ pārtha pūrvamuktaḥ svayaṃbhuvā

The eldest's share is to be the "eldest" one, the single share that is chief. This, Partha, is the rule of inheritance declared of old by the Self-existent.

Verse 59 (13.82.59)

samavarṇāsu jātānāṃ viśeṣo'styaparo nṛpa | vivāhavaiśiṣṭyakṛtaḥ pūrvapūrvo viśiṣyate

Among sons born of wives of the same class there is yet another distinction, O king: it is made by the standing of the marriage, and each earlier one outranks the one after.

Verse 60 (13.82.60)

harejjyeṣṭhaḥ pradhānāṃśamekabhāryāsuteṣvapi | madhyamo madhyamaṃ caiva kanīyāṃstu kanīyasam

Even among the sons of one wife, the eldest takes the chief share, the middle one the middle share, and the youngest the youngest share.

Verse 61 (13.82.61)

evaṃ jātiṣu sarvāsu savarṇaḥ śreṣṭhatāṃ gataḥ | maharṣirapi caitadvai mārīcaḥ kāśyapo'bravīt

Thus among all the classes the son of a wife of the same class has attained pre-eminence. The great sage Kashyapa, son of Marichi, has said this too.
